Florida Insurance Commissioner Kevin McCarty is imposing regulation on car insurance companies that prohibit them from using credit scores when approving or denying applications unless they can prove that their use is not unfairly discriminatory. "Many religious and ethnic minorities often have limited or no credit history by choice or because they are beginning to climb the economic ladder," explained McCarty. "This should bear no relationship to what they pay for insurance or to what coverage is available to them." Several auto insurance groups including the Florida Insurance Council, the American Insurance Association, the Property and Casualty Insurers of America and the National Association of Mutual Insurance Companies have announced that they will challenge McCarty. They saw that a 2003 law allows the use of credit scoring, that they always comply with the law and they do not discriminate. McCarty's regulation also allows drivers who are denied based on credit scores to appeal.
